Crushing blow for fly tipper
A man who had his van seized in a dawn swoop has had it crushed by Kirklees Council after pleading guilty to fly tipping offence.
In October 2019, Raymond Nawoor (46) of The Clearings, Leeds and an unknown associate had used the Ford Transit to dump builder’s waste and furniture onto Saville Street in Batley.
A local business reported the incident to the council after catching the incident on their CCTV. The footage showed the van reversing down Saville Street before raising the flatbed tipper, dumping its contents onto the highway and driving away.
The council was able to use the CCTV footage to trace the vehicle back to Nawoor at his address in the Belle Isle area of Leeds.
The council’s enforcement officers carried out a dawn raid to seize the vehicle in November 2019 with support from West Yorkshire Police. Following the raid, the council then invited Nawoor to interviews with enforcement officers on two separate occasions but he failed to attend.
The case appeared before Kirklees Magistrates on 1 March 2021, where Nawoor pleaded guilty to one count of fly tipping in contravention of Section 33 of the Environmental Protection Act 1990.
Nawoor was handed a fine of £60, plus victim surcharge of £32, costs of £940 and the forfeiture and destruction of his Ford Transit tipper van.
Councillor Naheed Mather, Cabinet Member for Environment commented:
“We all have legal and moral obligations to make sure we dispose of our waste responsibly. Thankfully most people do, but sadly a small minority don’t.
I’d like to thank the business for reporting this incident to us. We investigate all incidents of fly tipping to track down offenders if we can and take action even if, like in this case, they live outside of Kirklees. Where we have enough evidence we will prosecute through the courts where penalties can be much harsher than a fixed penalty notice. As a result, not only does this person have a hefty bill to pay, but they’ve also lost their vehicle because of their unlawful actions.
The council continues to support the SCRAP national campaign. This campaign reminds people who ask others to remove bulky waste on their behalf to check they use a licensed carrier, either by asking to see their Waste Carrier’s Licence or by looking the company up on the Environmental Agency website. This way you know your waste will be disposed of responsibly.”
