New Building Safety Levy to come into effect from 1 October 2026

We are reminding developers planning major residential schemes that the new Building Safety Levy will come into effect on 1 October 2026. 

The levy forms part of the building control process and will apply to certain major residential developments of more than 9 units. Anyone planning a development of 9 or more units should consider the implications early when programming their project and deciding which building control route to follow. 

Which developments could be affected? 

The Building Safety Levy may apply to: 

  • new residential developments 
  • purpose-built student accommodation 
  • some change of use projects that create residential accommodation 

The levy applies to applications for building control approval submitted through: 

  • Local Authority Building Control 
  • The Building Safety Regulator 
  • Initial Notices submitted through Registered Building Control Approvers (private building control) 

Applications submitted before midnight on 30 September 2026 will be dealt with in a case-by-case basis if they are not validated before the 1 October 2026 dependant on whether all relevant all information is provided on submission.
